Federal Judge Orders Release of Abrego Garcia from Immigration Detention
A court has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks lawful basis.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The situation originates in a mistaken deportation to El Salvador in March, which the government later admitted was an mistake. Following his repatriation to the United States to answer human smuggling charges, he was detained in federal custody.
In her order, the court noted that the government lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
